Everyone has to use legal remedies to stop this madness. Judges and lawyers are there to enforce freedom when the government and its police do not.
A wind of freedom is blowing over Baden-Württemberg. Since February 11, and despite the partial confinement that reigns in Germany , several towns and districts of this land bordering France are no longer subject to the curfew regime, in force everywhere else, reports in particular France 3 Grand Est. The municipalities concerned can thank a resident of Tübingen, in the center of the region, who had challenged this restriction in court and won her case.
This anonymous German indeed had urgently seized the administrative court of Mannheim to put an end to this measure which she considered unnecessary. The justice finally agreed with him, considering that a curfew was no longer justified in view of the health situation. The magistrates in particular argued the incidence rate of Baden-Württemberg, which went from 200 new cases per 100,000 inhabitants at Christmas time to 59 Tuesday, February 9, details “Les Dernière Nouvelles d’Alsace”. They therefore decided that a general curfew was not justified and that it even violated the fundamental freedom of movement.
Thus, 18 towns and districts of Baden-Württemberg out of 44 are affected by this lifting of the night curfew. Among them, three border districts of France (Rastatt, Emmendingen, Friborg-Black Forest) and three neighboring towns (Karlsruhe, Baden-Baden and Friborg). On the other hand, as soon as one of these local communities sees its incidence rate exceed the limit of 50 positive cases per 100,000 inhabitants, it will have to restore the curfew locally, specifies France 3.
